Undue Influence/Elder Abuse/Will Contests
Undue influence “reaches every case, and grants relief where ‘influence is acquired and abused, or where confidence is reposed and betrayed’” and is applied to void such transactions as deeds, contracts, and wills. In re Jane Tiffany Living Trust 2001, 177 P. 3d 1060, 1063 (Nev. 2008). A presumption of undue influence arises when a fiduciary relationship exists (that is when one places her/his trust and confidence in another—for example, a relative, investment advisor, lawyer, partner, business associate, or bank) and the fiduciary benefits from the questioned transaction.
