THE CASE OF A LIFE DESTROYED BY A RECKLESS PLUMBER
On August 7, 2007, John Boren, Age 74, was driving a truck and trailer hauling asphalt south bound on Pyramid Lake Highway when Jose Estrada-Rocha ran a stop sign while heading west bound on Calle de la Plata and collided with the truck driven by Mr. Boren.
Mr. Estrada-Rocha, who was employed by A Plumberman, and working within the course and scope of his employment, died at the scene of the crash. Mr. Boren suffered horrendous injuries and incurred hundreds of thousands of dollars in medical bills.
Because Mr. Boren was employed by Atlas Trucking, and suffered an on the job injury, workers compensation paid out medical and other benefits and claimed a lien in excess of $400,000.
As the result of negotiations with A Plumberman’s liability carrier (American Family Insurance) and Atlas’ uninsured motorist carrier (Zurich Insurance) each carrier tendered their respective $1,000,000 policy limits, for a total settlement of $2,000,000.
Likewise, after both litigation and negotiation with the Workers’ Compensation Administration (CCMSI). The lien claim was compromised and resolved.
